DMCA Policy

Channelziq, Inc. ("Channelziq," "we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to notices of alleged copyright infringement that comply with the DMCA and applicable law.

1. Reporting Copyright Infringement

If you believe that content available on or through the Channelziq service infringes your copyright, please submit a notification containing the following information to our designated DMCA agent:

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
  2. Identification of the infringing material: Identify the material that you claim is infringing and that you want removed or access to which you want disabled, with enough detail for us to locate the material (e.g., URL or other specific description).
  3. Your contact information: Include your full legal name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your signature: A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.

2. Designated DMCA Agent

Please send all DMCA takedown notices to our designated agent:

Important: Only DMCA notices should be sent to the designated agent. Any other inquiries should be directed to support@channelziq.com.

3. Our Response to Takedown Notices

Upon receiving a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that it has been removed or disabled.
  • Provide the user with a copy of the takedown notice and inform them of their right to submit a counter-notification.

4. Counter-Notification Process

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our DMCA agent containing the following:

  1. Identification of the material: Identify the material that was removed or disabled and the location where it appeared before it was removed.
  2. Statement under penalty of perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Channelziq may be found), and that you will accept service of process from the person who provided the original DMCA notification or their agent.
  4. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  5. Your signature: A physical or electronic signature.

5. Restoration of Material

Upon receiving a valid counter-notification, we will:

  • Forward the counter-notification to the original complainant.
  • Inform the complainant that we will restore the removed material in 10 business days unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in the infringing activity.
  • Restore the material between 10 and 14 business days after receiving the counter-notification, unless the complainant notifies us of a filed court action.

6. Repeat Infringers

In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of users who infringe any intellectual property rights, whether or not there is any repeat infringement.

7. Misrepresentation Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
